3. This page suggests otherwise. Wink I think it's just the fact that it's based off the sets so much, they couldn't take him out fully...

5. But they're both Glatorian. Unlike the Toa comparison. Wink Legends is just the sub-name to differentiate it from the winter sets, probably as a movie Tie in.

Can't read that page. But why would I trust a wiki from a site that doesn't appear to be owned by Lego to decide if it's an animal or a vehicle?

As I posted above the description from the set itself pretty much dictates it's a vehicle.

Now sure lets say he could create a new living entity but then they are stating it needs a pilot. Not a rider, but a pilot.

*New Edit* It's possible the movie makers did that (stupid if they did) but it is possible. But you'll note that's not just bits and pieces that's all of Telluris in there feet to head to hands.
